The sponsor needs to be sure that he has enough money to support his spouse and that his spouse won’t be a drain on Canadian resources before completing a sponsorship application. A new application for the same spouse cannot be submitted if the sponsorship application is still being reviewed and a decision has not been made. In a similar vein, it is challenging to sponsor someone if you or they have been convicted, are incarcerated, have precarious finances, or rely on government aid.

Applicants can stay in Canada as their application seeking permanent residence is being carried out with the help of inland spousal sponsorship. To keep their citizenship in Canada while their sponsorship application is being reviewed, applicants with temporary status documents that do not last the duration of the sponsorship processing term must submit an application for an extension or a new status document. 

In most circumstances, requests for spousal sponsorship are handled within a year. It is acceptable, but not advised, to travel outside of the country while an inland sponsorship application is being reviewed. A sponsorship application may be declared abandoned if the sponsored individual is refused re-entry into Canada for any reason. Should this occur, they would have to apply for sponsorship again. An application for foreign spousal sponsorship must be made if they are not legitimately resident in Canada.

Requirement 

  • Eligibility for sponsoring a spouse for immigration to Canada requires the applicant to be either a Canadian citizen or a permanent resident living in Canada.
  • The sponsoring applicant must be at least 18 when submitting their sponsorship application.
  • A spouse cannot have previously sponsored the applicant for immigration to Canada within the last five years.
  • If the applicant is a permanent resident of Canada, they must not be subject to a deportation order, insolvent, incarcerated, or facing serious charges.

Outland

Regardless of where they currently reside, a Canadian citizen or permanent resident may sponsor their spouse or common-law partner for Canadian permanent residence through the outland spousal sponsorship stream of the family sponsorship program. Most applications are handled within a year as part of Canada’s commitment to reuniting families as soon as possible. 

The outland spousal sponsorship program was created for sponsored people who live abroad. Still, Canadian residents can also apply because it may allow them to travel within Canada and outside of it while their application is being reviewed.

In order to submit a spousal sponsorship application, both the Canadian sponsor and the individual being sponsored must fulfil specific eligibility conditions. Spouse or common-law partner sponsorship requires the following:

  • Must be a Canadian citizen or permanent resident living in Canada
  • Must be at least 18 years of age
  •  Must not have received spousal sponsorship to Canada in the five years preceding their application
  • Must not be in prison, charged with a serious offense, or bankrupt
  • Must not be under deportation order, if they are a Canadian permanent resident
